नैनीताल : देहरादून जिले के जौनसार भाबर क्षेत्र में संविधान में एससी-एसटी के लिए किए गए विशेष प्रविधान का उल्लंघन कर जमीनों की बंदरबांट करने का बड़ा मामला उजागर हुआ है। हाई कोर्ट में जनहित याचिका दायर होने के बाद सरकार से जवाब मांगा गया तो जिला प्रशासन दून की जांच पड़ताल में चकराता क्षेत्र में 49 लीजधारकों को प्रथमदृष्टया भू कानून के उल्लंघन का दोषी माना है। अब जिला प्रशासन ने इन लीजधारकों को नोटिस जारी कर जवाब मांगा है। सरकार की ओर से हाई कोर्ट में इस कार्रवाई का जवाब दाखिल किया गया है। कोर्ट की सख्ती के बाद लीजधारकों में खलबली मची है।

उत्तर प्रदेश के 1950 के भू कानून के अनुसार एससी-एसटी की भूमि न खरीदी जा सकती है और न ही लीज पर दी जा सकती है। इसके लिए जिलाधिकारी की अनुमति जरूरी है। जब चकाराता क्षेत्र में तमाम उद्यमियों व रसूखदारों को भूमि नहीं मिली तो उन्होंने मनमाने तरीके इजाद कर लिए। याचिकाकर्ता के अनुसार संविधान के अनुच्छेद-46 में एससी-एसटी को विशेष दर्जा प्राप्त है, मगर चकराता क्षेत्र में तमाम उद्योगों को मनमाने तरीके से भूमि लीज पर दी गई है। जिसमें 30 साल की लीज देने के बाद ऑटोमेटिक रिन्यूवल का विवादित प्रविधान भी शामिल है।

भूमि हथियाने को बना दिए मनमाने नियम

हाई कोर्ट में दाखिल याचिका में यह उदाहरण दिया गया है कि उद्यमियों द्वारा लीज डीड में 30 साल के बाद स्वत: लीज रिनुअल की शर्त रख दी गई। याचिकाकर्ता के अधिवक्ता अभिजय नेगी के अनुसार इससे तो भूमि पर अनंत काल तक लीजधारक का अधिकार हो जाएगा। लीज से संबंधित दस्तावेजों में यह भी शर्त गैरकानूनी व नियम विरुद्ध तरीके से जोड़ी गई है कि जिसके द्वारा भूमि लीज पर दी जाएगी, उस परिवार का कोई सदस्य इस प्रविधान को अदालत में चुनौती नहीं दे सकता। हाई कोर्ट में इससे संबंधित दस्तावेज भी पेश किए जा चुके हैं। याचिका में कहा गया है कि जैव विविधता की दृष्टिï से समृद्ध चकाराता का जौनसार भाबर क्षेत्र के अलावा पिथौरागढ़ के मुनस्यारी क्षेत्र में भी भूमि के धंधेबाजों की नजर लगी है। याचिका में मांग की गई है कि चकाराता व मुनस्यारी को मसूरी व नैनीताल जैसा बनने से रोका जाए। मसूरी व नैनीताल में अवैध निर्माण की वजह से जैव विविधता दागदार हो चुकी है।

सख्त भू कानून जरूरी

अधिवक्ता अभिजय नेगी कहते हैं कि राज्य में सख्त भू कानून जरूरी है। जैव विविधता की दृष्टिï से समृद्ध इलाकों में जिस तरह भूमि की अंधाधुंध खरीद फरोख्त हो रही है, इसे रोकने के लिए सख्त भूमि कानून जरूरी हो गया है।

हाई कोर्ट ने मांगा है जवाब

यह मामला 16 जून को हाई कोर्ट में जनहित याचिका के रूप में सूचीबद्ध हुआ था। मुख्य न्यायाधीश न्यायमूर्ति आरएस चौहान व न्यायमूर्ति आलोक कुमार वर्मा की खंडपीठ में भारतीय सेना से वीआरएस लेकर आए चेतन चौहान की जनहित याचिका पर सुनवाई हुई थी। याचिकाकर्ता का कहना था मनमानी लीज से चकाराता क्षेत्र के पर्यावरण व जैव विविधता पर बुरा प्रभाव पड़ रहा है। याचिकाकर्ता के अधिवक्ता अभिजय नेगी के अनुसार कोर्ट ने इस मामले में सुनवाई करते हुए पक्षकारों को जवाब देने के निर्देश दिए हैं। अगली सुनवाई 18 अगस्त को नियत है।
