हाईकोर्ट ने फेल छात्रों को बिना टीसी, शिक्षा का अधिकार अधिनियम (आरटीई) के तहत नई कक्षा में प्रवेश दे रहे स्कूलों की जांच करने के निर्देश मुख्य शिक्षा अधिकारी हरिद्वार एवं सचिव विद्यालयी शिक्षा को दिए हैं। कोर्ट ने सीईओ हरिद्वार से कहा कि महानिदेशक विद्यालयी शिक्षा के निर्देशों का पालन करते हुए चार माह में जांच पूरी करें।

स्कूल एवं अभिभावकों के लिए ठोस नियम भी बनाएं। मामले की सुनवाई न्यायमूर्ति शरद कुमार शर्मा की एकलपीठ में हुई। इस मामले में सीबीएसई एवं आईसीएससी स्कूल एजुकेशन एसोसिएशन के रुड़की चेयरमैन की ओर से याचिका दायर की गई है। इसमें कहा गया है कि हरिद्वार सहित प्रदेश के कई हिस्सों में कुछ स्कूलों द्वारा सीबीएसई एवं आईसीएससी बोर्ड के प्रवेश नियमों का उल्लंघन किया जा  रहा है।

कई स्कूल बिना टीसी के 10वीं एवं 12वीं की कक्षाओं में छात्रों को प्रवेश दे रहे हैं। जबकि यह छात्र दूसरे स्कूलों में कक्षा नौ एवं 11वीं में फेल हो चुके हैं। ऐसे में शिक्षा का अधिकार अधिनियम के तहत पात्र छात्रों को स्कूलों में प्रवेश नहीं मिल पा रहा है। उनकी शिक्षा प्रभावित हो रही है। याचिकाकर्ता ने कोर्ट एवं सरकार से इस तरह के फर्जीवाड़े पर रोक लगाने की अपील की है।

शिक्षा महानिदेशक के आदेश पर भी नहीं हुई जांच
याचिकाकर्ता का यह भी कहना है कि उनके द्वारा दिए गए प्रत्यावेदन पर 27 नवंबर 2020 को महानिदेशक विद्यालयी शिक्षा ने मुख्य शिक्षा अधिकारी हरिद्वार को मामले की जांच के आदेश दिए थे। लेकिन अब तक मामले की न तो जांच शुरू हुई है और न ही कोई उचित कदम उठाया गया है। जिससे इस तरह के फर्जीवाड़े को बढ़ावा मिल रहा है।
