 नैनीताल। सरोवर नगरी की ऐतिहासिक नगरपालिका के सभासदों ने सामुहिक रूप से इस्तीफा देकर नई बहस छेड़ दी है। यह पहला मौका है जब सभासदों में अभूतपूर्व कदम उठाते हुए दलीय सीमा लांघकर पालिका प्रशासन को कठघरे में खड़ा किया है। सबसे दिलचस्प यह है कि सरकार द्वारा नामित सभासद भी इसमें शामिल हैं, जबकि नियमानुसार उन्हें पालिका बोर्ड में मत विभाजन का अधिकार नहीं है। इस सबसे इतर जानकारों का कहना है कि सभासदों ने इस्तीफा नियमानुसार दिया है न ही सही अधिकारी को।

दरअसल शुक्रवार को सभासद मनोज जगाती, सुरेश चंद्र, कैलाश रौतेला, प्रेमा अधिकारी, मोहन नेगी, सपना बिष्ट, नामित सभासद मनोज जोशी, राहुल पुजारी, तारा राणा, राजू टांक, सागर आर्य के अलावा अन्य सभासदों ने सामुहिक इस्तीफा देकर कमिश्नर कार्यालय में सौंप दिया। इन सभासदों ने दावा किया कि सभासद दया सुयाल, निर्मला चंद्रा, रेखा आर्य की भी मौखिक सहमति ली है। अब इस मामले पर सियासत से इतर कानूनी बहस भी छिड़ गई है। जानकारों के अनुसार जब सभासदों को शपथ जिलाधिकारी द्वारा दिलाई गई तोB इस्तीफा भी उन्हें ही दिया जाता तो उसकी प्रासंगिकता होती। साथ ही इस्तीफा सामूहिक नहीं अलग अलग दिया जाता। उसमें इस्तीफे की ठोस वजह दी जानी चाहिए।

पूर्व पालिकाध्यक्ष मुकेश जोशी बताते हैं कि राज्य में प्रभावी उत्तर प्रदेश नगरपालिका अधिनियम की धारा 39 में साफ कहा है कि यदि अध्यक्ष से भिन्न नगरपालिका का कोई सदस्य लिखकर अपने हस्ताक्षर से त्यागपत्र देता है तो तदुपरांत उसका स्थान रिक्त हो जाएगा। त्यागपत्र जिसमें नगरपालिका  स्थित हो, जिला मजिस्ट्रेट कार्यालय में दिया जाएगा। अध्यक्ष इसकी सूचना राज्य सरकार को देगा। धारा 39 के विस्तार में ही यह कहा गया  है कि उत्तर प्रदेश नगरपालिका अधिनियम 1916 की धारा 39 में सदस्य को स्वेच्छा से त्यागपत्र देने का अधिकार देती है लेकिन जिला मजिस्ट्रेट द्वारा यह जांच जरूरी है कि क्या त्यागपत्र स्वच्छापूर्वक दिया गया है। त्यागपत्र तभी मंजूर होता है जब डीएम उसे सीधे सरकार को भेज दे या राज्य सरकार को अग्रसारित करने के लिए संस्तुति कर दे।
