नैनीताल : हाई कोर्ट ने शिक्षा विभाग के चतुर्थ श्रेणी कर्मचारियों को एसीपी (सुनिश्चित कॅरियर प्रोन्नयन) का लाभ दिए जाने को लेकर एकलपीठ के आदेश को चुनौती देती सरकार की विशेष अपील को खारिज कर दिया है, साथ में एकलपीठ के निर्णय की सही ठहराया है।

मंगलवार को मुख्य न्यायाधीश न्यायमूर्ति आरएस चौहान व न्यायाधीश एनएस धानिक की खंडपीठ में मामले की सुनवाई हुई। दरअसल शिक्षा विभाग में कार्यरत दिनेश चंद्र जोशी व त्रिभुवन कोहली सहित करीब 48 लोगों ने पूर्व में याचिका दायर कर कहा था कि सरकार उनको एसीपी का लाभ नहीं दे रही है जबकि अन्य विभागों में चतुर्थ श्रेणी कर्मचारियों को इसका लाभ दिया जा रहा है। एकलपीठ ने उनके हक में फैसला देते हुए कहा था कि प्रदेश के सभी चतुर्थ श्रेणी कर्मचारियों को एसीपी का लाभ दिया जाए। आदेश हो जाने के बाद भी सरकार ने उनको एसीपी का लाभ नहीं दिया।

इसी बीच सरकार द्वारा एकलपीठ के आदेश को विशेष अपील दायर कर चुनौती दी। हाईकोर्ट की खंडपीठ ने पूर्व में एकलपीठ के आदेश पर रोक लगा दी थी। इस रोक को हटाने के लिए याचिकाकर्ता द्वारा खण्डपीठ में प्राथर्ना पत्र दिया था। खंडपीठ ने सरकार की विशेष अपील ख़ातिज कर दी। याचिकाकर्ता के अधिवक्ता ललित सामंत ने बताया की इस निर्णय से प्रदेश के समस्त चतुर्थ श्रेणी के कर्मचारियों को एपीसी मिलने का रास्ता साफ हो गया है।
