नैनीताल। हाईकोर्ट नैनीताल ने हरिद्वार जिले में त्रिस्तरीय पंचायत चुनाव पंचायतों का कार्यकाल खत्म होने के एक साल बाद भी नहीं कराने पर नाराजगी व्यक्त की है। सुनवाई के दौरान सरकार की ओर से इस मामले में जवाब कि लिए समय मांगा तो कोर्ट ने पांच जुलाई तक स्थिति साफ करने को कहा है।

शुक्रवार को मुख्य न्यायाधीश न्यायमूर्ति विपिन सांघी व न्यायमूर्ति एसके मिश्रा की खंडपीठ में हरिद्वार निवासी रंजन त्यागी की याचिका पर सुनवाई की। याचिका में हरिद्वार में त्रिस्तरीय पंचायत के चुनाव कराने के लिए डिनोटिफिकेशन को चुनौती दी गई है। याचिका में कहा गया है कि जब पंचायतों का कार्यकाल समाप्त हुए एक साल से अधिक हो गया तो सरकार परिसीमन में बदलाव नहीं कर सकती।

सुप्रीम कोर्ट ने साफ कहा है कि पंचायतों का कार्यकाल खत्म होने के बाद सरकार सिर्फ छह माह तक प्रशासन नियुक्त कर सकती है। इसके बाद सरकार को चुनाव कराने होंगे। हरिद्वार में त्रिस्तरीय पंचायतों का कार्यकाल 29 मार्च 2021 को समाप्त हो गया है। कोर्ट ने राज्य निर्वाचन आयोग को भी पक्षकार बनाने को कहा है। अगली सुनवाई पांच जुलाई को होगी।

अलग से होता है हरिद्वार का पंचायत चुनाव
हरिद्वार एकमात्र उत्तराखंड का एक ऐसा जिला है, जिसमें पंचायत चुनाव राज्य के शेष 12 जिलों के साथ नहीं होते। राज्य गठन के बाद से ही यह परिपाटी चली आ रही है। पिछले वर्ष मार्च से जून के मध्य पंचायतों का कार्यकाल खत्म होने के बाद इन्हें प्रशासकों के हवाले कर दिया गया था। पंचायतीराज अधिनियम के अनुसार प्रशासन कार्यकाल छह माह से अधिक नहीं हो सकता। बावजूद इसके प्रशासक कार्यकाल में चुनाव नहीं हो पाए तो सरकार ने अधिनियम में संशोधन पारित कराकर प्रशासकों का छह माह का कार्यकाल बढ़ाया, लेकिन इस अवधि में भी चुनाव नहीं हो पाए।
