नैनीताल: हाई कोर्ट ने रामनगर में मानसिक दिव्यांग बच्चों के आवासीय विद्यालय में एक बच्चे के गायब होने के मामले में दायर याचिका पर सुनवाई की।

मुख्य न्यायाधीश न्यायमूर्ति विपिन सांघी व न्यायमूर्ति आरसी खुल्बे की खंडपीठ ने गृह सचिव को गायब बच्चों के सम्बंध में सुप्रीम कोर्ट के दिशा निर्देशों को लेकर सर्कुलर जारी करने के आदेश दिये हैं।

साथ ही एसएसपी नैनीताल को भी सर्कुलर को थाना चौकी स्तर पर सर्कुलेट करने को कहा है। साफ कहा है कि बच्चों के गायब होने के मामले में गंभीर धाराओं में मुकदमा दर्ज किया जाए।

बाल कल्याण सोसायटी को इस मामले में दिए गए सुझावों पर विचार कर निर्णय लेने को कहा है। सभी पक्षकारों से सात नवंबर तक जवाब पेश करने को कहा है।

शुक्रवार को खंडपीठ के समक्ष एसएसपी पंकज भट्ट व रामनगर एसएचओ व्यक्तिगत रूप से पेश हुए। एसएसपी ने कोर्ट को अवगत कराया कि बच्चे के गायब होने के मामले की एफआईआर दर्ज कर ली है। बच्चे की तलाशी के ल‍िए एक टीम भी गठित कर दी है।

इस दौरान रजिस्ट्रार न्यायिक की अध्यक्षता में बनी जांच कमेटी की रिपोर्ट कोर्ट में पेश की गई। जिसमें अनियमितता का जिक्र तो नहीं है लेकिन स्टाफ आदि के प्रशिक्षित नहीं होने का उल्लेख किया क‍िया है।

हल्द्वानी की रोशनी सोसायटी ने जनहित याचिका दायर कर कहा था कि रामनगर के बसई में कुमाऊं का एकमात्र मेंटली चाइल्ड रेजिडेंसीएल स्कूल है, जो राज्य सरकार की वित्तीय मदद पर चलता है।

इस स्कूल में अनाथ, अनाम, बच्चे को चाल्ड वेल्फेयर सोसायटी भर्ती करती है। बच्चा जो सही तरीके से बोल नहीं पाता था 12 अगस्त को स्कूल से गायब हो गया था। एक अन्य बच्चे ने भी स्कूल के अध्यापकों पर मारपीट का आरोप लगाया था।

शाम को बच्चे का सिर फटा पाया गया। पता करने पर स्कूल प्रबंधन ने सफाई दी कि वह झूले से गिर गया। स्कूल प्रबंधन ने बच्चे की गुमसुदगी की रिपोर्ट नौ सितम्बर को 25 दिन बीत जाने के बाद लिखाई ।

पुलिस ने कहा कि इसमें मुकदमा दर्ज करने की आवश्यकता नहीं है, क्योंकि कोई अपराध नहीं हुआ है। इन घटनाओं का संज्ञान बाल सुधार आयोग ने लिया था।

याचिका में यह भी कहा गया है कि सुप्रीम कोर्ट ने अपने आदेश में कहा है कि अगर कोई बच्चा कैसे भी गायब हुआ हो, पुलिस उसका मुकदमा अपहरण की धारा में दर्ज करे, जब‍क‍ि पुलिस ने अभी तक इस मामले में मुकदमा तक दर्ज नहीं किया है। कोर्ट ने एसएसपी को अगली सुनवाई में व्यक्तिगत पेशी से छूट प्रदान की है।
