विधायक की याचिका निरस्त करने के प्रार्थना पत्र खारिज, अब 16 नवंबर से होगी नियमित सुनवाई

नैनीताल : हाईकोर्ट ने लोहाघाट से कांग्रेस विधायक खुशाल सिंह अधिकारी के निर्वाचन को चुनौती देती याचिका पर अहम आदेश पारित किया है। कोर्ट ने भाजपा के पूर्व विधायक पूरन सिंह फर्त्याल की चुनाव याचिका पर वाद बिंदुओं पर विधायक अधिकारी की आपत्तियों को खारिज कर दिया है।

साथ ही पूर्व विधायक को 11 नवंबर तक याचिका में आपत्तियां दूर करने तथा 16 नवंबर से मामले में नियमित सुनवाई का आदेश भी पारित किया है। इस आदेश को विधायक के लिए झटका जबकि पूर्व विधायक के लिए सियासी जीत के रूप में माना जा रहा है।

लोहाघाट विधान सभा सीट पर भाजपा के पराजित प्रत्याशी पूरन फर्त्याल ने कांग्रेस के विजयी प्रत्याशी खुशाल सिंह अधिकारी के निर्वाचन को हाई कोर्ट में चुनौती दी थी। याचिका में कहा गया है कि अधिकारी ने 24 जनवरी 2022 को नामांकन किया किन्तु शपथ पत्र 28 जनवरी को दाखिल किया जबकि यह नामांकन पत्र के साथ ही दाखिल होना था। यही नहीं शपथ पत्र में उन्होंने गलत सूचनाएं दी।

नामांकन के समय उनके 25 सरकारी कार्यों के ठेके चल रहे थे,जिसे उन्होंने छुपाया है। सुनवाई के दौरान विधायक अधिकारी ने न्यायाधीश न्यायमूर्ति रवींद्र मैठाणी की एकलपीठ में प्रार्थना पत्र दाखिल कर याचिका में कमियां बताते हुए निरस्त करने की याचना की थी। अधिकारी का कहना था कि याचिका जनप्रतिनिधित्व कानून के तहत दाखिल नहीं हुई है।

फर्त्याल की ओर से दाखिल शपथपत्र में उनके प्रार्थना वाले स्थान पर दस्तखत नहीं हैं। जो याचिका के साथ संलग्नक लगाए हैं, वह सत्यापित नहीं हैं। कोर्ट ने मामले में सुनवाई पूरी कर निर्णय सुरक्षित रखा था। जिसे बुधवार को सुनाते हुए कहा कि याचिका में ऐसी कमियां नहीं हैं, जिसे दूर नहीं किया जा सके।
