नैनीताल : हाई कोर्ट ने उत्तराखंड में लोकायुक्त की नियुक्ति एवं लोकायुक्त संस्थान को सुचारू करने को लेकर दायर याचिका पर सुनवाई की। कोर्ट ने प्रदेश सरकार को तीन सप्ताह में शपथ पत्र के माध्यम से यह बताने को कहा है कि लोकायुक्त की नियुक्ति के लिए क्या कार्रवाई की है। कहा कि शपथ पत्र में संस्थान बनने से 31 मार्च 2023 तक वर्षवार कितना खर्चा किया गया है, उसका विवरण भी आना चाहिए। मामले में अगली सुनवाई आठ मई को होगी।

शुक्रवार को मुख्य न्यायाधीश न्यायमूर्ति विपिन सांघी व न्यायमूर्ति आलोक कुमार वर्मा की खंडपीठ में हल्द्वानी निवासी रविशंकर जोशी की याचिका पर सुनवाई हुई। जिसमें राज्य में स्वतंत्र और निष्पक्ष जांच एजेंसी के रूप में लोकायुक्त की नियुक्ति की मांग की गई है। याचिका में कहा गया है कि लोकायुक्त संस्थान के नाम पर वार्षिक 2 से 3 करोड़ खर्च हो रहे हैं, लेकिन प्रदेश सरकार ने आज तक लोकायुक्त की नियुक्ति नहीं की।

कहा कि उत्तराखंड में तमाम घोटाले हो रहे हैं। वर्तमान में राज्य की सभी जांच एजेंसी सरकार के अधीन हैं, जिसका पूरा नियंत्रण राज्य के राजनैतिक नेतृत्व के हाथों में रहता है। राज्य में कोई भी ऐसी जांच एजेंसी नही है जिसके पास यह अधिकार हो कि वह बिना शासन की पूर्वानुमति के किसी राजपत्रित अधिकारियों के विरुद्ध भ्रष्टाचार का मुकदमा पंजीकृत कर सके या जांच को किसी न्यायालय में चार्जशीट दाखिल कर सके।

वर्तमान व्यवस्था में राज्य सरकार के प्रभाव व हस्तक्षेप से मुक्त ऐसी कोई भी जांच एजेंसी नहीं है जो किसी भी जनप्रतिनिधि या किसी भी लोकसेवक के विरुद्ध स्वतंत्र व निष्पक्ष जांच और कार्रवाई कर सकें। विजिलेंस विभाग भी राज्य पुलिस का ही हिस्सा है, जिसका सम्पूर्ण नियंत्रण पुलिस मुख्यालय, सतर्कता विभाग या मुख्यमंत्री कार्यालय के पास ही रहता है। विजिलेंस का भारतीय प्रशासनिक सेवा, राज्य प्रशासनिक सेवा के किसी अधिकारी या किसी शीर्ष राजनैतिक व्यक्ति पर कार्यवाही का कोई इतिहास नहीं है।

जांच एजेंसी को किन-किन बिंदुओं पर जांच करनी है, जांच एजेंसी में नियुक्ति व स्थानांतरण सहित सभी प्रशासनिक अधिकार, जांच समिति का बजट, चार्जशीट दाखिल करने की स्वीकृति देना, अभियोग दर्ज करने की स्वीकृति देना, जांच की पूरी मॉनिटरिंग, जांच अधिकारियों को सभी प्रकार के निर्देश देना, जांच की समीक्षा करना आदि पूरा नियंत्रण राजनैतिक नेतृत्व के हाथों में रहता है।

जांच एजेंसियों में राज्य सरकार के नियंत्रण वाले कर्मचारी और अधिकारी ही जांच अधिकारी होते हैं। राज्य के अब तक के इतिहास में किसी शीर्ष राजनैतिक या प्रशासनिक व्यक्ति की जांच और कार्रवाई का नहीं होना इसका स्पष्ट प्रमाण है। हर प्रतियोगी परीक्षा में हुई धांधली, खनन भूमि सहित प्रशासनिक स्तर पर गंभीर भ्रष्टाचार के अनगिनत प्रकरणों में, जनप्रतिनिधियों व लोकसेवकों की अर्जित अकूल संपत्ति की कोई स्वतंत्र और निष्पक्ष जांच का उदाहरण प्रस्तुत नहीं किया है।
